Sofia Vergara Heading Back to Court After Ex Granted New Complaint

And so the saga continues. It seems Sofia Vergara can't catch a break in what looks to be a never-ending court battle with ex Nick Loeb regarding the future of two female embryos the couple created. Nick has already accused the Modern Family star of bullying, and was just allowed to file an amended lawsuit seeking custody. The embryos in question were created while the two were still together, and this new complaint introduces a claim that Sofia breached an oral agreement "to create the embryos and bring them to term via a surrogate," reports ET Online. Sofia's lawyer, Fred Silberberg, has already told the court that there is "no legal issue" since the couple already agreed — and signed — a form sighting the need for both parties to permit use of the embryos. Fred also added that, "embryos are not children." Sophia is now engaged to Magic Mike XXL star Joe Manganiello, and recently told Good Morning America, "It shouldn't be out there for people to give their opinion when there's nothing to talk about. There's papers signed. There is a court date. He shouldn't be creating something so ugly out of nothing."
